1. INTRODUCTION

Welcome to Perú Increíble. We are excited to assist you in planning your journey to explore Peru’s breathtaking landscapes, rich culture, and spiritual heritage. These Terms and Conditions govern your use of our services and website, as well as your purchase of any tour package or experience (the “Tour”). Please read them carefully beforeproceeding with any bookings.

2. AGREEMENT

2.1 Legally Binding Agreement

By booking a Tour with Perú Increíble, you enter into a legally binding agreement (the “Agreement”) between you and Perú Increíble. This Agreement governs your purchase of any Tour, and by proceeding, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

2.2 Privacy Policy

Perú Increíble also has a separate Privacy Policy, which is incorporated into this Agreement by reference. You agree to be bound by our Privacy Policy, available at [Insert Website URL].

2.3 Arbitration and Dispute Resolution

This Agreement includes a mandatory arbitration provision that requires any disputes to be resolved through individual arbitration rather than jury trials or class actions. SeeSection 14 (Dispute Resolution) for details.

3. ELIGIBILITY

You represent that you are at least 18 years old and legally qualified to enter into contracts. If you are booking on behalf of another person or entity, you confirm that you have the authority to act on their behalf and enter into this Agreement on their behalf.

4. PAYMENTS

4.1 Payment Methods

To purchase a Tour, you must provide a valid payment method such as a credit card, debit card, bank transfer, or another approved method. You confirm that you are authorized to make payments using your selected method.

4.2 Deposits and Payment Schedule

Private Group Partnerships (Retreats)
• A non-refundable $500 USD deposit per person is required at the time of booking for each participant.
• A second deposit equal to 50% of the total retreat cost is due 60 days prior to arrival.
• The remaining 50% balance is due upon arrival in Cusco, unless otherwise agreed in writing.

Private Tours (Custom or Pre-Designed Itineraries)
• A 50% deposit of the total tour cost is required at the time of booking.
• The remaining 50% balance is due upon arrival in Cusco, unless otherwise agreed in writing.

Failure to make payments by the stated deadlines may result in cancellation of services without refund of amounts already paid.

4.3 Price Adjustments

Perú Increíble reserves the right to adjust prices due to changes in government taxes, permit fees, fuel costs, foreign exchange rates, or other unforeseen expenses beyond our control. If a significant adjustment becomes necessary, clients will be informed as soon as possible.

5. CANCELLATION AND REFUND POLICY

This policy applies to Private Group Partnerships (Retreats) and Private Tours.

All cancellation requests must be submitted in writing. If you cancel your Tour, you may be eligible for a refund according to the following schedule:

Additional Terms

• Deposits are part of the total tour or retreat cost and are subject to the cancellation policy above.
• Certain components such as Machu Picchu permits, train tickets, domestic flights, special event tickets, or customized services may be fully non-refundable once purchased, regardless of cancellation date.
• Clients are responsible for additional costs resulting from voluntary itinerary changes before or during travel.
• Date changes may be possible on a case-by-case basis and must be completed within 6 months of the original booking date. Price differences and new service rates may apply.
• No refunds will be issued for unused services due to late arrival, early departure, or missed activities.

6. TRAVEL INSURANCE

Travel insurance is mandatory for all travelers with Perú Increíble. We strongly recommend obtaining comprehensive insurance covering trip cancellations, delays, medical emergencies, and lost luggage. Some policies require purchase within two weeks of booking, especially “Cancel For Any Reason” (CFAR) plans.

7. AIRLINE AND THIRD-PARTY SERVICES

Additional terms from airlines, hotels, and service providers may apply. Perú Increíbleis not responsible for airline penalties, fees, or changes made by third-party providers. Flight schedules, fares, and conditions are subject to change without notice.

8. INTERNATIONAL TRAVEL RESPONSIBILITIES

You are responsible for ensuring that you meet all foreign entry requirements, including having a valid passport, visas, and necessary vaccinations. Perú Increíble is not responsible for denied entry due to documentation issues.

9. ELECTRONIC COMMUNICATIONS

By booking a Tour, you agree to receive electronic communications from Perú Increíble, including emails related to your booking and promotional offers.

10. INTELLECTUAL PROPERTY RIGHTS

All content on our website and marketing materials is the property of Perú Increíble. You may not copy, modify, distribute, or exploit any content without prior written consent.

11. LIMITATION OF LIABILITY

Perú Increíble acts solely as an intermediary between travelers and independent third-party service providers, including but not limited to hotels, transportation companies, guides, airlines, and activity operators. Perú Increíble does not own, operate, or control these providers and shall not be liable for any injury, illness, death, loss, damage, delay, or inconvenience arising from the acts or omissions of such third parties.

Travel involves inherent risks, including but not limited to altitude-related illness, physical exertion, transportation incidents, weather conditions, political or social disruptions, public health events, and other unforeseen circumstances. By booking a Tour, you voluntarily assume all such risks.

Perú Increíble shall not be liable for any indirect, incidental, consequential, or punitive damages. In all circumstances, the maximum liability of Perú Increíble shall not exceed the total amount paid by the traveler for the Tour.

Nothing in this section excludes liability in cases of proven gross negligence or willful misconduct by Perú Increíble.

12. INDEMNIFICATION

You agree to indemnify and hold Perú Increíble, its employees, partners, and service providers harmless from any claims, losses, or damages resulting from your participation in a Tour.

13. DISPUTE RESOLUTION

13.1 Arbitration Agreement

Any disputes arising from this Agreement will be resolved through binding arbitration in Cusco, Peru. The decision of the arbitrator shall be final and binding.

13.2 Class Action Waiver

You agree not to file any claims as a class action or collective lawsuit.

13.3 Small Claims Option

If eligible, you may bring an individual claim in small claims court in Peru.

14. TERMINATION

Perú Increíble reserves the right to refuse service, cancel bookings, or terminate this Agreement at our discretion for any reason, including violation of these Terms.

15. GENERAL TERMS

• This Agreement constitutes the entire understanding between you and Perú Increíble.

• If any provision is found unenforceable, the remaining terms remain in effect.

• These Terms may be updated at any time, and continued use of our services constitutes acceptance of any changes.
